ERWAY

Five sources · one clear outcome per plot · no site visit to start

Screen every plot for protected areas, Indigenous land rights, World Heritage sites and protected wetlands — and get a clear outcome for each one.

Upload your plots — a supplier's farms, a project site or an entire portfolio — and Legality Assessment checks each polygon against protected-area records, Indigenous and community land-tenure records, World Heritage and biosphere sites, protected wetlands and threatened-species occurrence data. Each plot receives a single outcome, from 'No findings' to 'Prohibited', together with the restriction tier and the source behind it. A map shows exactly where the overlap lies, and the export takes the findings straight into your report, credit file or audit. It runs on ERWAY's satellite-backed geospatial platform, on the same plot register used for EUDR and Plant Health.

The outcome is a preliminary screening against international protection records. It tells you which plots need a permit, a document or community consent before you go any further. It is not a legal opinion, and every finding is labelled accordingly.

    Land-tenure records

Tenure status and community identity for each overlap; consent flag

  • World Heritage and biosphere sites

Inside the plot and within 1 km; informational only

  • The outcome scale

    Five outcomes

No findings → Informational → Verification needed → Restricted → Prohibited

  • The tier scale

    Six tiers

Tier 1 is the strictest, tier 6 the weakest; the strictest tier on the plot applies

  • The strictest-finding rule

    One rule

The most serious finding on any single plot sets the project outcome

Five sources, one outcome scale and one rule for combining them. None of it is configurable per customer, so two people looking at the same plot always see the same result.

5

Sources each plot is checked against. Four determine the outcome; the fifth — threatened species — is shown alongside it for context and never affects it.

1

Outcome per plot. The most serious finding across the four deciding sources sets it, and a clean result from another source never softens it.

0

Plots reported as clean while their checks are still pending. 'Not checked yet' and 'No findings' are always kept apart.

Rule descriptions reflect the application as of 20 September 2026. Distances and buffers on this page are configurable defaults and are labelled as such; computed footprints are labelled as approximate.

Modules

One screen for each question a plot raises

Is the plot inside a protected area? Whose land is it? Is it near a World Heritage site or a wetland of international importance? Which threatened species have been recorded there? Each module below answers one of these questions for every plot, and each one is a real screen in the product.

Dashboard

Projects by outcome, and checks still in progress

Every project sits in one of five outcomes, and the dashboard counts plots rather than averaging scores. Below it, the check queue shows which source has answered for how many plots and when each source's records were last updated. A plot whose checks are still running is never counted as clean.

  • Counts by outcome — no blended score

Every polygon you hold, in one project

Upload GeoJSON or enter coordinates. The plot's own properties — a supplier's plot code, a cadastral reference — become its identity in every table and export, so each finding stays tied to the plot it belongs to. A plot without geometry is kept and marked 'Not assessable' rather than dropped or treated as clean.

Protected areas

Overlap with a protected area, in hectares and in legal terms

Every overlapping area is listed separately with its category, its protection class where the record has one, the overlap in hectares and as a share of the plot, and the resulting restriction tier. Where the class is not recorded, the card says 'unknown' — never 'unprotected'.

Indigenous and community lands

Whose land it is, and whether consent is documented

Land held, used or claimed by Indigenous Peoples and local communities, with its tenure status: documented, recognised but undocumented, claim submitted, or customary. Indigenous land carries a consent flag, and the project counts the plots that need it. A country panel gives the tenure-security context for the country as a whole — clearly marked as country-level information, not a statement about the plot.

  • Tenure status and community identity for each overlap
  • Plots requiring community consent, counted
  • Indicative-only records shown as information, never as findings

World Heritage and wetlands

International designations, with footprints drawn as accurately as the data allows

World Heritage sites, Biosphere Reserves and Global Geoparks, plus wetlands of international importance under the international wetlands convention. Where an official boundary is published, it is used. Where only a centre point and a size are known, the footprint is a computed circle with a confidence rating, and every finding based on it is labelled approximate. A low-confidence circle can never make a plot 'Prohibited'.

Relation to each site's footprint. Approximate footprints are labelled as such.

Approximate

Approximate footprint

Heritage sites are published without boundaries. Each site is a circle computed from its published size, with a confidence rating of high, medium or low. A low-confidence circle can never make a plot 'Prohibited'. A protected wetland site uses its official boundary where one is published, and a disc around the centre point where not.

Five outcomes, six tiers, one rule: the most serious finding across the four deciding sources determines the result. Sources

Five sources, named for what they are

Four of them determine the outcome; the fifth provides context. Each card explains what the source contains, how a plot is compared against it, and what it cannot tell you.

Determines the outcome

Protected areas

What it contains
Areas placed under protection by national or international law: national parks, nature reserves, wildlife sanctuaries, sustainable-use areas and water-protection zones.
How a plot is compared
Polygon overlap. Every overlapping designation is listed separately with its category, class, hectares and share of the plot.
What it cannot tell you
The record's start date rarely allows a cut-off date to be established, so the product does not claim one.
Determines the outcome

Indigenous and community lands

What it contains
Land traditionally owned, used or claimed by Indigenous Peoples and local communities: titled, acknowledged by the state, under a formal claim, or held by custom.
How a plot is compared
Polygon overlap. Point-located lands are treated as small circles. Indicative country-wide layers are shown as information only.
What it cannot tell you
Coverage varies between countries; an absence of records is not an absence of rights.
Determines the outcome

World Heritage and biosphere sites

What it contains
World Heritage sites, biosphere reserves and global geoparks designated under the international heritage programmes.
How a plot is compared
Relation to a footprint computed from the site's published size: core, property, buffer, transition, near (default 5 km) or vicinity (default 25 km), each with a confidence rating.
What it cannot tell you
Heritage sites are published without boundaries. Every footprint is an approximation, and each finding is labelled accordingly.
Determines the outcome

Protected wetlands

What it contains
Wetlands of international importance designated under the international wetlands convention: lakes, marshes, mangroves and peatlands.
How a plot is compared
Official boundary where published; otherwise a disc around the centre point. Inside, near (default 1 km) or far (default 10 km).
What it cannot tell you
Designation criteria and wetland type come from the official site record, which each finding links to.
Informational only

Threatened species

What it contains
Plant and animal species listed as threatened under the global threat categories, recorded inside the plot or within one kilometre of it.
How a plot is compared
Records inside vs nearby, grouped by category; the risk follows from the highest category present, with cultivated commodities excluded.
What it cannot tell you
Informational only. Records show where observers have been, not where species are absent.

Outcomes

Five outcomes, six tiers, and the check states in between

The outcome says what the law allows on the plot. The tier says how strict the strictest finding is. The check state says whether an answer exists yet.

Five outcomes

Prohibited

Converting this land for production is legally prohibited.

Restricted

Use of this area requires a permit or is subject to conditions.

Verification needed

A record was found; confirm the protection terms with the competent authority.

Informational

A record exists but carries no legal restriction; shown for information only.

No findings

No record found in any source.

Six tiers

Tier 1 is the strictest, tier 6 the weakest. The strictest tier found on a plot becomes the plot's tier.

Tier 1

Strictly protected area (national park, nature reserve, natural World Heritage site, biosphere core zone): converting land for production here is legally prohibited.

Tier 2

Recognised Indigenous land or mixed World Heritage site: conversion is not lawful without the community's documented consent; confirm against the official record.

Tier 3

Restricted-use area (sustainable-use area, community land, buffer zone, official wetland): conversion requires a permit and is unlikely to be lawful; a case-by-case review is needed.

Tier 4

Internationally designated site or its surroundings: confirm the protection terms with the competent authority.

Tier 5

Water, resource or species protection zone, or a transition zone: use may require a permit.

Tier 6

Weak signal (military area, cultural heritage, land cover, outer band, forestry designation): mostly informational.

Check states

One state per source per plot. The state says whether an answer exists — not what the answer is.

Not checked yet

The plot is queued, or the source has not been imported yet. This is not the same as 'No findings'.

Checking…

A worker is currently comparing the plot with this source.

Checked

A result exists, with or without findings, and is dated.

Check failed

Five attempts failed; the previous result, if there is one, remains visible.

To be re-checked

The source has been re-imported; the result shown is the previous one.

Not assessable

The plot has no geometry.

'Not checked' is not the same as 'clean'

A source that has not yet answered for a plot is shown as 'Not checked yet', with a clock icon. A plot only shows 'No findings' once every available source has answered. A project whose plots have not all been checked shows 'Checks in progress' instead of an outcome.

Precedence

  1. Prohibited
  2. Restricted
  3. Verification needed
  4. Informational
  5. No findings

Worst first: Prohibited → Restricted → Verification needed → Informational → No findings. 'Verification needed' counts as a finding: it is included in the count, the filter and the 'decided by' line.

Why

What this software deliberately does not do

A screening tool is only useful if it is clear about its limits. These are ours.

No legal opinion

The outcome is a preliminary screening against protection records. The legal decision rests on documents and on the records of the competent authority, and every finding is labelled accordingly.

No single score

Five outcomes and six tiers, each with its reason. Nothing is averaged into a number that hides which source said what.

No species in the outcome

Threatened-species records are context. They change neither the outcome nor the tier, and the panel that shows them makes this clear.

No hidden approximations

Where a footprint is a computed circle, the finding is labelled approximate and carries a confidence rating. A low-confidence circle can never make a plot 'Prohibited'.

No substitute for the national register

International records do not contain every national designation. Where a country's own register is the authority, the page tells you to consult it.

No silent 'clean'

A plot whose checks are still queued shows 'Not checked yet'. It is never counted as having no findings.

No summed overlaps

Hectares are reported per source and never added up across sources, because two of the footprints are approximate.

No manual re-check button

Results refresh automatically when a source's records are re-imported, and the previous result stays visible until the new one is ready. There is no button that pretends the underlying record has changed.

How it works

Upload the plots, let the checks run, read the outcome by source, check the map, export

  1. 1

    Upload the plots

GeoJSON or coordinates, with whatever properties identify the plot for you. Plots without geometry are kept and flagged.

  2. 2

The checks run in the background

Five queues, one per source. The project shows 'Checks in progress' until every available source has answered; during a re-check the previous result stays visible.

  3. 3

    Read the outcome by source

One outcome for the project, with the deciding sources named. One row per source for every plot: findings, overlap, tier and outcome — or the current state of the check.

  4. 4

    Look at the map

The overlapping part of the plot, the footprint that caused it, and the distance band it falls in. Approximate footprints are dashed.

  5. 5

    Export the findings

CSV or GeoJSON, with every finding, its source, its tier and its date. Share the tab with the reviewer who needs it.

Where it fits

One screening, many frameworks that ask for it

Every framework below asks a version of the same question: is this site in or near a protected or sensitive area, and whose land is it? Legality Assessment answers that question for each plot. It does not complete the framework for you — each card says what remains to be done.

TNFD — Locate

TNFD LEAP approach, phase L

Which operating and supplier sites are in or near protected areas, protected wetlands, World Heritage sites and lands of Indigenous Peoples. One outcome per site, ready to export.

What remains: The Evaluate, Assess and Prepare phases remain your work.

CSRD — ESRS E4

ESRS E4 disclosure requirements on sites in or near biodiversity-sensitive areas

A per-site record of overlap with protected areas and international designations, with hectares and check dates.

What remains: Impact and dependency assessment, targets and the disclosure itself remain your work.

IFC PS6 and the Equator Principles

Performance Standard 6 pre-screening

An early desktop screening of protected and internationally recognised areas around a project site, before field work begins.

What remains: Critical-habitat determination and the field baseline remain specialist work.

Project siting

Solar, wind, mining, forestry, plantations

Candidate sites compared against the same five sources before land is optioned, with approximate footprints kept visible.

What remains: The environmental assessment itself is not replaced.

Carbon and restoration projects

Tenure and safeguards screening

Community-land tenure status and the consent flag for each polygon, plus designations and species context.

What remains: Consultation and consent are processes, not records.

EUDR — Article 3(b)

Regulation (EU) 2023/1115

Whether a production plot overlaps an area protected under the relevant legislation of the country of production (Art. 3(b); Art. 2(40)(b), (c), (d), (g)), and whether Indigenous Peoples are present or have raised a claim (Art. 10(2)(c)–(e)). The plot register is the same one the EUDR product already holds.

What remains: The risk assessment, mitigation and the due diligence statement remain the operator's responsibility.

Sourcing and supplier sites

Supplier onboarding, ESRS E4 value chain, CSDDD

A supplier's farms, factories or concessions screened in bulk before the contract is signed — one outcome per site, with the record behind it.

What remains: The supplier's own permits, and the audit that reviews them, remain your work.

Permits and environmental assessment

EIA screening, Natura 2000 pre-screening, RED III acceleration areas, CRMA projects

Which candidate sites touch a protected area, a wetland or a designation the permitting authority will ask about — known before the application is written.

What remains: The environmental impact assessment, the appropriate assessment and the permit itself remain the authority's process.

Limits

What the records can and cannot tell you

Every limit below is also shown in the product wherever it applies.

Approximate footprints

Heritage sites are computed circles with a confidence rating; protected wetland sites without a published boundary are discs. Distances and relations in those findings are approximate and labelled as such.

Coverage

International records do not include every national designation, riparian buffer or legal-reserve rule. Where a national register is the authority, consult it; the page is noted on the affected sources.

Defaults

Species search area: one kilometre. heritage-site near and vicinity bands: 5 and 25 km. wetland near and far bands: 1 and 10 km. These are deployment defaults, not legal thresholds.

Refresh

Results refresh when a source is re-imported. There is no per-plot re-check button and no live query against the source when you open the page.

No field data

Nothing here replaces a survey. Species records show where observers have been, not where species are absent.

Access and API

Access to the tab is per user, and results are exported as files. There is currently no public API for legality results.

Integration

The plot register you already have

Plots geolocated for EUDR or monitored with Plant Health are the same plots. Legality Assessment reads them from the same register and stores its findings alongside them.

Shared plot register

One polygon, three products: EUDR due diligence, Plant Health monitoring and Legality Assessment screening.

GeoJSON in, GeoJSON and CSV out

Import from any GIS; export with every finding to any GIS, spreadsheet or report.

Per-user tab access

Give a reviewer access to the legality tab without the rest of the project.

Exports logged

Who exported what, and when.

Not building

  • A biodiversity score or index
  • A critical-habitat determination
  • A national cadastre or permit lookup
  • A public API, until the results contract is stable
  • An automatic decision on any plot
