PPWR penalties

Enforcement under PPWR has two layers, and the first surprises people. Under Article 62(1) a missing or incorrect technical file or declaration of conformity is independently enforceable — you do not need to have breached a substantive limit for it to be a finding.

The second layer is national. Article 68 requires Member States to lay down penalty rules and notify them by 12 February 2027, and for the Articles 24 to 29 obligations those must include administrative fines. Amounts are therefore set nationally and are not in the Regulation, so identical conduct carries different exposure in different markets. Article 15(10) is where documentary weakness usually becomes visible: a competent authority asks, and a short window starts.
